End-User License Agreement

This End-User License Agreement ("EULA") is a legal agreement between you (an individual or a single entity) and Vladyslav Fedoniuk ("I", "me") for the UpWatchr software application, including its components, updates and later versions (the "Software"). By installing, copying or otherwise using the Software, you agree to this EULA. If you do not agree, do not install or use the Software.

Grant of license

I grant you a personal, non-exclusive, non-transferable, limited license to install and use the Software free of charge on Windows devices you own or control, for personal or commercial purposes, as long as you comply with this EULA.

Restrictions

You agree not to:

• modify, reverse engineer, decompile or disassemble the Software, except where the law expressly allows it;
• sell, rent or lease the Software, or redistribute modified copies of it;
• remove or alter any proprietary notices in the Software;
• use the Software to send requests to systems you are not authorized to test, or to overload or disrupt any service;
• use the Software for any unlawful purpose.

Ownership

The Software and all intellectual property rights in it are owned by Vladyslav Fedoniuk. The Software is licensed, not sold.

Updates

The Software checks for updates and can download and install them. Updates may fix bugs, add or change features, or be new versions; this EULA applies to them unless they come with their own terms.

Your data

The Software stores your monitors, history and settings on your device. What it sends over the network, including the update check, is described in the Privacy Policy. You are responsible for the addresses you monitor and for the alert destinations you configure.

No warranty

The Software is provided "as is", without warranty of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement. I do not warrant that the Software will be uninterrupted or error-free, or that it will detect every outage. It only monitors while your computer is running. Do not rely on it as your only safeguard for anything critical.

Limitation of liability

To the maximum extent permitted by applicable law, I shall not be liable for any damages whatsoever - including loss of data, loss of profits, business interruption or a missed alert - arising out of the use of or inability to use the Software, even if I have been advised of the possibility of such damages. As the Software is free, my entire liability under this EULA is limited to €1.

Termination

This EULA is effective until terminated. It terminates automatically if you fail to comply with it; you must then stop using the Software and delete all copies.

Governing law

This EULA is governed by the laws of Poland. Any dispute arising out of it is subject to the exclusive jurisdiction of the courts in Rzeszów, Poland, without prejudice to any mandatory consumer rights you have where you live.

General

This EULA is the entire agreement between you and Vladyslav Fedoniuk about the Software. If any provision is found unenforceable, the rest remains in effect. I may update this EULA; the current version is always published on this page.

UpWatchr is built, owned and operated by Vladyslav Fedoniuk as an individual developer. BitQuail Sp. z o.o., the developer's company, provides the correspondence address above and the code-signing certificate for the installer; it has no other involvement in UpWatchr.
